Terms & Conditions

Introduction

Welcome to impactfulgiving.in platform, operated by Impactful Giving Welfare Foundation ("we", "us", or "our"), a Section 8 company incorporated under the Companies Act, 2013 (India). These Terms and Conditions ("T&Cs"), along with any policy or other document referred to herein, govern how a person ("you") can access or use the platform ("Platform").

By using the Platform, you confirm that you have read, understood, and agreed to these T&Cs. If you do not agree, you should not use the Platform.

General Access Terms

  1. Users of the Platform: Users may include (i) Donors contributing to charitable programs, and (ii) Visitors browsing for informational purposes.
  2. Ownership and Responsibility: The Platform is owned and operated by Impactful Giving Welfare Foundation.
  3. Age Restrictions: You must be 18 years or older to access or use the Platform, in compliance with Section 11 of the Indian Contract Act, 1872.
  4. Privacy: Any information you provide will be used only in accordance with our Privacy Policy.
  5. Service Availability: We may provide technical support but this is not guaranteed. The Platform may be temporarily unavailable for maintenance.
  6. Changes to the Platform: We reserve the right to modify or discontinue the Platform, or update these T&Cs at any time.

Services Offered

  1. Facilitation of Donations: The Platform offers donation pages where individuals can contribute to specific charitable programs. All donations are collected by Impactful Giving Welfare Foundation and disbursed to intended partner organisations at our discretion.
  2. Third-Party Fees: Impactful Giving does not charge fees for donations. However, third-party payment processors may apply standard processing fees.
  3. User Registration: Users are not required to create an account. However, to make donations, we will collect your name, email address, physical address, and optionally your PAN card number for tax deduction certificates.

Content and Intellectual Property Rights

All content, logos, and images on the Platform are protected by intellectual property laws under the Copyright Act, 1957 and may not be reproduced without explicit consent.

Accuracy of Information

While we strive to ensure accuracy of information provided on the Platform, we do not guarantee that all information is complete, accurate, or up-to-date.

Disclaimer of Warranties

The Platform and all content are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, regarding the Platform and donations.

Indemnification

You agree to indemnify and hold harmless Impactful Giving Welfare Foundation from any claims, damages, liabilities, costs, or expenses arising from your use of the Platform.

Payments and Refund Policy

  1. Payments: Payments can be set up as recurring, which can be cancelled or changed by emailing team@impactfulgiving.in.
  2. Refunds: All donations are final and non-refundable except in cases of technical errors. Refund requests must be made within 7 days.

Dispute Resolution

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India. These T&Cs are governed by the laws of India.

Acknowledgment

By using the Platform, you acknowledge that you have read and understood these T&Cs and agree to be bound by them.
